These Terms of Use apply to the Inner Voice mobile application and related services (the "Application"), operated by Kerim Bayalan, InnerVoice, Lothstraße 84, 80335 Munich, Germany (the "Service Provider", "we"). By downloading or using the Application, you agree to these Terms. Please read them carefully.
You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to use the Application. If you are younger, a parent or legal guardian must review and accept these Terms on your behalf. By using the Application you represent that you are legally permitted to do so in your jurisdiction.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on your mobile device for personal purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile or disassemble the Application, except to the extent expressly permitted by applicable law.
All intellectual property rights in the Application — including its code, design, affirmation content, trademarks, logos and branding — remain the property of the Service Provider. Nothing in these Terms grants you a right to use our trademarks or branding. You agree not to remove or alter any proprietary notices in the Application.
The Application offers a free tier limited to five (5) affirmation sessions per user account (lifetime). Additional features ("Inner Voice Premium") require a paid subscription, currently offered as:
Prices may vary by region and are always displayed in the app before purchase. All purchases are processed exclusively through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
Auto-renewal: Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your store account is charged for renewal within 24 hours prior to the end of the current period at the price of your selected plan.
Cancellation: You can manage or cancel your subscription at any time in your App Store or Google Play account settings (in the app: Settings → Manage Subscription). Deleting the Application does not cancel a subscription. Cancellation takes effect at the end of the current billing period; access to Premium features continues until then.
Refunds and withdrawal: Refunds are handled by Apple or Google in accordance with their respective terms; we cannot issue refunds for store purchases directly. For consumers in the EU, any statutory right of withdrawal for purchases processed by Apple or Google is exercised through Apple or Google in accordance with their processes.
Price changes: We may change subscription prices for future billing periods. You will be informed in advance in accordance with the applicable store's rules and, where required, asked to consent; otherwise your subscription will not renew at the new price.
The Application is a self-improvement and wellbeing tool. It is not a medical device, does not provide medical, psychological or psychiatric advice, diagnosis or treatment, and is not a substitute for professional care by a physician, psychotherapist or psychiatrist.
Content in the Application — including affirmations, sleep sessions and educational material about neuroscience — is provided for general informational and motivational purposes only. Scientific references describe general research findings and do not promise individual results.
If you are in crisis or experience thoughts of self-harm or suicide, do not rely on this Application. Contact a qualified professional or local emergency services immediately (EU emergency number: 112; in Germany, the Telefonseelsorge is available free of charge at 0800 111 0 111).
You use the Application at your own responsibility. To the extent permitted by law, the Service Provider is not liable for consequences of using the Application as a replacement for professional medical or psychological care.
Content you create in the Application — custom affirmations and voice recordings — is private to your account and is not visible to other users or the public. You retain all rights to your content. You grant us only the limited technical license required to store, process and display this content back to you as part of operating the Application. We do not use your content for any other purpose and do not sell or sublicense it.
You agree not to create content that is illegal, infringes third-party rights, or contains malware. We may remove content and suspend accounts in cases of illegal use.
You can delete your account at any time in the app under Settings → Delete Account; this permanently removes your data as described in the Privacy Policy. We may suspend or terminate access if you materially breach these Terms — where the breach is curable, we will give you notice and 14 days to remedy it; in cases of illegal activity or harm to others we may suspend access immediately. Upon termination, your license ends and you must delete the Application from your devices.
The Application uses third-party services that have their own terms:
Some functions require an active internet connection. We are not responsible if the Application cannot function fully due to missing connectivity, exhausted data allowances, or an uncharged device. Charges from your mobile provider (including roaming) are your responsibility. We advise against using the Application on jailbroken or rooted devices, as this may compromise security and functionality.
We may update the Application from time to time; you should accept updates when offered, as we may cease to support earlier versions. We may modify features or, with reasonable notice where legally required, discontinue the Application. Nothing in these Terms limits rights you have under applicable consumer protection law that cannot be lawfully excluded.
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits or data loss. We retain full liability for death or personal injury caused by negligence, for fraud, and for any liability that cannot be excluded under applicable law. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or the minimum amount required by applicable law, whichever is greater.
To the extent permitted by law, you agree to indemnify the Service Provider against claims and reasonable costs arising from your breach of these Terms or intentional misuse of the Application. This does not apply to claims arising from our own negligence or breach of law, and is limited in jurisdictions where consumer indemnification is restricted.
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules — except that if you are a consumer residing in another country, you also enjoy the protection of the mandatory consumer protection provisions of that country. Disputes will be brought before the courts having jurisdiction under applicable law.
To the extent the Application qualifies as an intermediary service under Regulation (EU) 2022/2065, our single point of contact for authorities and users is innervoiceapp@outlook.de. Where we restrict content or accounts, affected users receive a statement of reasons and may request review; disputes may also be submitted to a certified out-of-court dispute settlement body under Art. 21 DSA.
If any provision of these Terms is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Application. We may update these Terms from time to time; changes are announced by posting the updated Terms with a new effective date. Previous versions are available on request.
